This document is provided for transparency and is not legal advice. A signed order form or master agreement governs enterprise engagements in case of conflict.
1. Agreement
These Terms govern your use of chainCheck, operated by Witty Inventions Digital LLC (Raleigh, NC). By creating an account or using the service you agree to them. Enterprise and Elite engagements may be governed by a separate signed order form, which controls in case of conflict.
2. The service
chainCheck provides AI governance documentation and blockchain-verified audit trails. It is a documentation and evidence tool. It does not constitute legal advice, regulatory approval, or a guarantee of compliance with any law or framework. You remain responsible for your governance decisions and regulatory obligations.
3. Accounts & access
You are responsible for the accuracy of records you enter, for safeguarding credentials, and for the actions of your organization's members. Role-based permissions are provided to help you control access.
4. Subscriptions & billing
Pilot and Professional are billed in advance (monthly or annually; annual billing includes one or more months free depending on tier). Enterprise and Elite are billed by invoice on net-30 terms under an annual commitment. Fees are non-refundable except as required by law. Blockchain verification is included in every tier and is not an add-on.
5. Blockchain records
Anchoring writes an irreversible cryptographic hash to a public blockchain. These entries are permanent and cannot be altered or removed by us or by you. Records and their verification certificates remain available and do not expire when a subscription ends.
6. Acceptable use
You may not misuse the service, attempt to breach security or access controls, or use it to violate law. We may suspend access for material breach.
7. Availability & warranties
The service is provided "as is". Elite includes an SLA with an uptime commitment; other tiers are provided on a commercially reasonable basis without an SLA. To the extent permitted by law we disclaim implied warranties.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability is limited to the fees paid in the twelve months preceding the claim. We are not liable for indirect or consequential damages.
9. Termination
You may cancel at any time; access continues through the paid period. Your verified records remain on-chain and exportable per the Privacy Policy.
10. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-laws rules.
